Fairin.eu is a service operated by SherpasDurden LLC, a company incorporated in USA with its registered office in Boston (MA).

These Terms & Conditions (“Terms”) govern your access to and use of the Fairin.eu website and services. By visiting our website or joining our waitlist, you agree to these Terms.

2. Our Services

Fairin.eu provides European-sovereign AI tooling and compliance infrastructure for businesses operating under the EU AI Act and GDPR. Our services include:

• AI-powered workflow automation built on European infrastructure
• GDPR and EU AI Act compliance configuration and monitoring
• Ongoing compliance dashboards and regulatory update services

During the current phase, we are operating an early access waitlist. Joining the waitlist does not constitute a binding contract for services. It represents your expression of interest, and we will contact you personally to discuss whether Fairin.eu is the right fit.

3. Eligibility

Our services are intended for businesses and professionals (B2B). By submitting our waitlist form or entering into a service agreement with us, you confirm that:

• You are acting in a professional or business capacity, not as a consumer
• You have the authority to bind your organisation to these Terms
• Your business is based in the European Union or European Economic Area, or you are seeking to comply with EU regulations in respect of your EU-based customers

4. Waitlist and Early Access

By joining the waitlist, you:

• Consent to being contacted by Fairin.eu to discuss early access
• Acknowledge that joining the waitlist does not guarantee access to any service
• Understand that Fairin.eu is in active development and features may change before launch

We reserve the right to accept or decline any waitlist application at our sole discretion. There is no obligation on either party until a separate written service agreement is signed.

5. Intellectual Property

All content on the Fairin.eu website — including text, graphics, logos, and software — is the property of SherpasDurden LLC or its licensors and is protected by applicable intellectual property laws.

You may not reproduce, distribute, or create derivative works from any content on this website without our prior written consent.

6. Acceptable Use

When using our website or services, you agree not to:

• Use our platform for any unlawful purpose or in violation of any applicable regulation
• Attempt to gain unauthorised access to any part of our systems
• Transmit malicious code, spam, or any content that is harmful, offensive, or deceptive
• Misrepresent your identity or your organisation
• Use our services in a way that would bring Fairin.eu into disrepute

We reserve the right to suspend access to any user who breaches these conditions.

7. Data Protection

Your use of Fairin.eu is subject to our Privacy Policy, which is incorporated into these Terms by reference.

As a European-sovereign AI service, we are committed to processing all data in full compliance with the GDPR. When you become a customer and we process personal data on your behalf (in our capacity as a data processor), a separate Data Processing Agreement (DPA) will be put in place as required by Article 28 GDPR.

8. Disclaimers and Limitation of Liability

8.1 Website availability

We aim to keep the Fairin.eu website available at all times but do not guarantee uninterrupted access. We may suspend, withdraw, or restrict access for technical or business reasons without notice.

8.2 Information accuracy

The information on this website is provided in good faith and for general informational purposes. It does not constitute legal advice. While we provide EU AI Act and GDPR compliance tooling, you remain responsible for your own legal compliance. We recommend seeking independent legal counsel for your specific situation.

8.3 Limitation of liability

To the fullest extent permitted by US and EU law, SherpasDurden LLC shall not be liable for any indirect, incidental, or consequential loss arising from your use of this website or reliance on its content, including but not limited to loss of profits, loss of data, or business interruption.

Nothing in these Terms limits our liability for fraud, death, or personal injury caused by our negligence, or any other liability that cannot be excluded by law.

9. Third-Party Links and Services

Our website may link to third-party websites or reference third-party tools (e.g. Hetzner, Mistral, n8n). We are not responsible for the content, privacy practices, or terms of any third-party websites. Links do not imply endorsement.
